1. Nature of Service

Paylink IT Systems is an Independent Software Vendor (ISV). We provide software-as-a-service (SaaS) tools for business automation. Paylink is NOT a bank, a Payment Service Provider (PSP), or a fund custodian. We do not hold, manage, or move your money.

2. Non-Custodial Software Model

All financial transactions triggered via Paylink Cloud or POS are settled directly into your own Safaricom M-PESA Till or Paybill number. Paylink has no access to these funds and cannot be held liable for settlement delays caused by the underlying payment rail (Safaricom).

3. User Responsibilities

  • You must maintain valid and authorized M-PESA Daraja API credentials.
  • You are responsible for all actions taken by "Attendant Accounts" created on your dashboard.
  • You must ensure that your use of the software complies with Kenyan tax laws regarding record-keeping.

4. Subscription Fees vs. Transaction Fees

Paylink charges a fixed Software Subscription Fee for access to our platform. We do not charge percentage-based commissions on your sales. Standard M-PESA transaction charges applied by Safaricom remain your responsibility.

5. Hardware (POS) Terms

If you purchase Paylink POS hardware, the software is provided under a license. The hardware itself is subject to Type Approval by the Communications Authority (CA). Unauthorized modification of the POS software may result in immediate account termination.

6. Limitation of Liability

As a technology provider, Paylink's liability is limited to the functionality of the software. We are not liable for:

  • Loss of funds due to M-PESA network failures or Safaricom downtime.
  • Unauthorized access resulting from compromised user passwords or API keys.
  • Any indirect or consequential losses resulting from business interruptions.

7. Governing Law

These terms are governed by the laws of Kenya. Paylink operates as an Application Service Provider (ASP) licensed by the Communications Authority.

By using Paylink, you acknowledge that you are using a software tool and that all financial liability for cash and digital funds remains with you and your chosen PSP.
